Iowa Pardon/Expungement Process

Iowa is one of the more restrictive states, so the details matter.

Iowa does NOT generally allow expungement of most adult convictions, especially felonies.
Instead, expungement is mostly limited to:

Also important: even when expunged, the record is sealed from public view, not completely erased.


✅ A. Non-convictions (most common path)

You may qualify if your case was:

  • Dismissed, or
  • Not guilty (acquitted)

Requirements:

  • Wait at least 180 days after dismissal/acquittal
  • Pay all fines, fees, and restitution
  • File a request (or sometimes the court can do it automatically)

👉 Result: The case becomes confidential and removed from public access


✅ B. Deferred judgment (very important in Iowa)

If you received a deferred judgment:

  • Complete probation successfully
  • Pay all obligations

👉 Then the record is automatically expunged under Iowa Code § 907.9

This is one of the main ways people in Iowa clear a record.


⚠️ C. Certain misdemeanor convictions (limited option)

Under Iowa Code § 901C.3:

You may expunge ONE misdemeanor conviction if:

  • At least 8 years have passed
  • No new charges are pending
  • All fines/fees are paid
  • You have limited prior deferred judgments

👉 This is very narrow:

  • Only one eligible conviction
  • Not available for most serious offenses

❌ D. Felony convictions

  • Almost never eligible for expungement in Iowa
  • Only possible in rare cases involving deferred judgment or special programs

Pardons are handled by the Governor of Iowa.

What a pardon DOES:

  • Restores rights (voting, firearms, etc.)
  • Forgives the offense legally

What a pardon does NOT do:

  • ❌ Does not erase or expunge your record
  • ❌ The conviction still appears on background checks

How pardons work:

  • You apply through the state clemency process
  • Reviewed and investigated
  • Final decision made by the governor

Most convictions are technically eligible, but approval is discretionary.

The state of Iowa offers a governor’s pardon only. Before submitting an application for restoration of firearms rights you should wait five years. An application for a pardon may be submitted ten years after the discharge of the sentence. This is the general policy of the governor’s office; applications may be submitted at any time. The process of obtaining a pardon and restoring rights will take place approximately two years form the time of application submission. The application will be forwarded to the department of public safety and division of criminal investigation. They will review criminal and traffic violations as well as credit history. The department of revenue must provide verification of income tax filings.

The Iowa Board of Parole will then review the materials and make a recommendation to the governor’s office.
